Introducers

1. Introduction

1.1. Welcome to Tribl

Welcome to Tribl, a pioneering company where creativity and support converge in a unique and meaningful way. Tribl’s mission is to empower Creators through direct engagement with their Fans, fostering a community of appreciation and inspiration. As a Site developed by Tribl AB, the vision is to provide an environment where creativity flourishes and meaningful connections are made.

1.2. Acceptance of terms

By using Tribl’s Site, the Creator and Fan agree to these Terms and Conditions ("Terms"), which govern the access to Tribl’s Site and its features. These features currently include guest checkout for Fan contributions, payouts to Creators via bank transfer, a personalized Link in Bio feature, and an analytics section to track engagement and support. Commitment to these Terms as a Creator or Fan on the Site is signified by the agreement.

2. Definitions

2.1. "Account"

means the account opened by a Creator on the Site.


2.2. "Benefits"

means the exclusive content, or privileges that a Creator offers to Fans as part of a Membership on the Site. These may include early access to content, behind-the-scenes material, personalized interactions, special merchandise, or other perks as defined by the Creator.

2.3. "Commission"

or “Platform Fee” means the standard commission of 5% charged to the Creator by Tribl AB in return for the Service provided. Tribl AB may propose promotional offers or reductions in its commission at its discretion.

2.4. "Creator"

means a natural person registered on the Site and having an Account which gives them access to their unique Tribl Page.

2.5. "Donations"

means the monetary value excluding the Transaction Fees that the Fan undertakes to give to the Creator.

2.6. "Fan"

means an individual who has given a Donation to at least one Creator or has subscribed to at least one Membership. Fans do not have an Account but can gain access via email OTP to view their transactions or to cancel a recurring donation or a recurring subscription.

2.7. "Memberships"

means a recurring Subscription service offered by a Creator to Fans on the Site, providing access to exclusive content, rewards, or privileges as specified by the Creator. Unlike Donations, with Memberships the Creator would be providing Benefits to Fans in exchange for their recurring support.

2.8. "One-off Donation"

means the monetary value excluding any third-party fees, not known to Tribl, that the Fan undertakes to give to the Creator on a one-off basis (only once).

2.9. "Payment Service Provider"

means the payment service providers indicated on the Site that enable the implementation of a payment. Payment Service Provider are companies that handle the transactions.

2.10. "Processing Fee"

means the fee paid by the Creator by deducting the amount from their payout or paid by the Fan and added to the amount of their payment.

2.11. "Profile Content"

means the Link URLs added to the Tribl Page, the icons associated with the Link URLs, the profile image, the background image, and any other text written by the Creator to customize their Tribl Page.

2.12. "Regular Donation"

means the monetary value excluding third-party fee, unknown to Tribl, that the Fan undertakes to give the Creator on a regular basis, if the Fan has opted for this form of support.

2.13. "Service"

means the Site service offered by Tribl AB whose purpose is to facilitate intermediation between Creators and Fans via the Site. This includes providing tools and features for the creation and management of Tribl Page. All Donations and Subscriptions are conducted directly between the Creator and the Fan through third-party Payment Service Providers.

2.14. "Site"

means the website located at http://www.tribl.com, or any other URL that Tribl AB may designate as a replacement, along with all associated tools and functionalities provided by Tribl AB, including but not limited to widgets, APIs, and related services.

2.15. "Subscription"

means a recurring financial commitment made by a Fan to support a Creator on the Site. Subscriptions enable Fans to access Memberships, which provide them with ongoing Benefits as defined by the Creator. Subscriptions are typically billed on a regular basis, such as monthly, and continue until the Fan cancels the recurring payment.

2.16. "Tribl"

means the company Tribl AB.

2.17. "Tribl Page"

means the page(s) of the Site created by the Creator and enabling a Fan to support the Creator.

3. User Account

3.1. Account creation

To become a Creator of the Site, it is a requisite that the Creator is at least 18 years of age, in compliance with the legal age requirement for entering into binding contracts. The process of signing up allows for different methods, including the use of an email and password, Google sign-in, Apple sign-in, or via the Creator’s phone number.
As a necessary part of the registration process, Tribl collects specific personal data, including the Creator’s name, date of birth, email, and phone number. This information must be precise and comprehensive, as it aids in establishing the Creator’s identity and facilitating the management of the Creators Account.

It is incumbent upon the Creator to refrain from masquerading as another individual, choosing offensive usernames, or infringing on the rights of others. Continued usage of the Site necessitates the verification of the Creator’s phone number and email address. This is an essential security measure put in place to safeguard the Accounts and uphold the integrity of Tribl’s user base.

When an Account is created, it is crucial that a username is chosen that respects the rights of all users, including intellectual property rights. The adoption of wellknown identities, indecent or offensive names, or usernames for profit, known as “Domain Squatting,” should be avoided. If issues arise, they will be assessed fairly, and the username may need to be modified, or Account suspension or termination may occur if there is a refusal. If intellectual property violations are claimed by external parties, a report must be submitted, and a counter notice can be responded with. Inactivity for six months may result in the username being reclaimed or reassigned, with prior notification given.

3.2. Account Responsibilities

Responsibility for all activities that occur under the Account is borne by the Creator. Secure storage and confidentiality of the password are also obligations that must be upheld. Any unauthorized access or usage of the Account should be promptly reported to Tribl. Continued use of the Site is considered an affirmation of acceptance of these Terms and a pledge to act responsibly on the Site.

Responsibility for the content posted on the Tribl Page also rests with the Creator. It should be ensured by the Creator that the content shared does not violate any intellectual property rights, is not offensive or harmful, and complies with Tribl community guidelines. Furthermore, any interactions with other users on the Site are the responsibility of the Creator. Respectful communication is encouraged, and any behavior that violates Tribl’s Terms should be reported.

3.3. Prohibited Actions on the Site

  • Do not post content that infringes upon any third party's intellectual property rights.
  • Do not post offensive, harmful, or defamatory content.
  • Do not engage in abusive, harassing, or threatening behavior towards other users.
  • Do not impersonate another individual or entity, or misrepresent an affiliation with any person or entity.
  • Do not use an Account for any illegal activities.
  • Do not attempt to gain unauthorized access to other user Accounts.
  • Do not attempt to disrupt or interfere with the proper functioning of the Site or any activities conducted on the Site.

3.4. Account Deletion

The Account can be deleted by the Creator using one of the following two options: deletion can be done directly from the profile settings or by contacting Tribl’s customer support team. It is important to understand that deletion of the Account will result in the permanent removal of all Account information, user data, and any associated content. Once deleted, the Account cannot be recovered, and if the Site is used again in the future by the Creator, a new Account will need to be created.

Please be advised that while all Account-related information will be removed from Tribl’s servers, any content shared with others or copied by others may still remain visible on the internet. By accepting these Terms, acknowledgment and agreement to Tribl’s Account deletion policy are confirmed.

Additionally, it should be noted that in some cases, certain information from the Account may remain visible due to sharing with social media or other services. Specific information may also be retained by Tribl as required by law or for legitimate business purposes.

If the Account remains inactive, meaning no log-in has occurred for a period longer than six (6) months, the right to close the Account is reserved by Tribl.

4. Content

4.1. Rights and Permissions for the Creator Tribl Page

When a Tribl Page is set up and customized, including the addition of Profile Content, ownership of this Profile Content is retained by the Creator. However, a nonexclusive, worldwide, royalty-free license is granted to Tribl to use, display, and distribute the Profile Content solely for the purpose of operating, promoting, and improving the Site. This license is non-transferable and non-sublicensable.

4.2. Key Aspects of the License

  • Worldwide Use: Profile Content may be used globally within the scope of the Site’s operation.
  • Royalty-Free: No fees or royalties will be paid for the use of any Tribl Page Content.
  • Duration: The license will last as long as there is an active Account.
  • Modification and Adaptation: Profile Content may need to be modified or adapted by Tribl for technical reasons, such as optimization for different devices and formats.
  • Content Management: We reserve the right, under our Terms and Community Guidelines, to remove, restrict, or label UGC that is deemed unsuitable for all audiences or that violates these guidelines.

4.3. Content Management and Moderation

  • Ownership and Responsibility: While you retain ownership of your UGC, you are fully responsible for it. You must ensure that you have all necessary rights to your content and that it complies with our Community Standards and applicable laws.
  • Sharing and Distribution: You acknowledge that your UGC may be shared publicly and is not subject to Tribl’s control over its subsequent use by others.
  • Prohibited Content: The right to remove or restrict any Profile Content that violates Tribl’s guidelines, including but not limited to illegal content, links to prohibited sites, or any content deemed harmful or inappropriate, is reserved by Tribl.

4.4. Intellectual Property Rights of Tribl

  • Ownership of Site Content: All content provided on Tribl’s Site, excluding Profile Content, such as text, graphics, logos, images, software, and other material, is the property of Tribl or its licensors. This content is protected by copyright, trademarks, patents, and other intellectual property laws.
  • Use of Tribl Content: Copying, modifying, distributing, selling, or leasing any part of Tribl’s Site or included software is not permitted, nor is reverse engineering or attempting to extract the source code of that software, without express written permission from Tribl.
  • Trademarks: The trademarks, logos, and service marks displayed on Tribl’s Site are registered and unregistered trademarks of Tribl and others. Nothing contained on Tribl’s Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark without the written permission of Tribl or the third party that owns the trademark.

4.5. Intellectual Property Rights of Creators

  • Respecting Creator Rights: Creators and Fans must respect the intellectual property rights of Creators. This includes not copying, modifying, or using another Creator's Profile Content without their explicit permission.
  • Reporting Infringements: If it is believed by a Creator that their intellectual property rights have been violated on Tribl’s Site, immediate notification to Tribl is encouraged. Appropriate action will be taken by Tribl on valid infringement notices.
  • Remedies for Infringement: Creators whose intellectual property rights have been infringed have the right to seek all remedies available by law for such violations.

5. Community Guidelines

5.1. Acceptable use

Tribl, strives to create a positive, inclusive, and respectful environment for all Creators on the Site. Tribl encourages behavior and content that:

  • Promotes creativity, collaboration, and constructive interaction.
  • Respects the rights, dignity, and diversity of others.
  • Adheres to the legal and ethical standards of content creation and sharing.

5.2. Unacceptable use

To maintain the integrity of the Site, the following behaviors and content are strictly prohibited:

  • Hate speech, harassment, or any form of discrimination based on race, ethnicity, gender, sexual orientation, age, disability, or religion.
  • Content that is obscene, sexually explicit, or promotes violence or illegal activities.
  • Spamming, fraudulent activities, or any form of manipulation or deception.
  • Infringing on the intellectual property rights of others.
  • Any other activities that disrupt the operation of the Site or harm other Creators and Fans.

5.3. Reporting and enforcement

Tribl relies on its community to help in maintainining these standards. A Creator who encounters any content or behavior that violates the Community Standards, it is encouraged to report it through Tribl’s designated reporting channels (support@tribl.app or by contacting a customer support agent through the Chat messaging service). Upon receiving a report, Tribl will:

  • Promptly review the content or behavior in question.
  • Take appropriate action, which may include removing content, issuing warnings, suspending or terminating Accounts, and/or involving law enforcement.
  • Maintain confidentiality and protect the identity of the reporting individual to the extent possible.

5.4. Moderation Processes

By creating an Account, the Creator agrees that in order to protect the Site and ensure the safety of all Creators and Fans, content must be moderated through both automated and non-automated processes. This includes:

  • Image Classification: Automated tools will classify and identify images to ensure they comply with Tribl’s Community Standards.
  • Text Moderation: Automated systems will detect harmful or inappropriate words and phrases in text to prevent the spread of harmful content.
  • Link Categorization: : Links added to Creators’ Tribl Page will be categorized, and any links to illegal content or prohibited sites will be banned.

By agreeing to these Terms, the Creator acknowledges and consents to the use of these moderation processes to ensure a safe and respectful environment on the Site.

6. Privacy and Security

The privacy and the security of the data are of paramount importance to Tribl. Tribl is committed to protecting all personal information and ensuring its confidentiality and integrity. When a Creator uses the Site, the personal data is processed in accordance with Tribl’s Privacy Policy, which outlines how Tribl collects, uses, stores, and protects the Creator’s information. This includes data obtained during Account registration, content interaction, and other Site activities.

Tribl employs robust security measures to safeguard information against unauthorized access, alteration, disclosure, or destruction. However, the Creator also bears the responsibility protecting their data, particularly by maintaining the confidentiality of their Account information and password.

By accepting these Terms and Conditions and using Tribl, you agree to the collection and use of your information as outlined in our Privacy Policy.

7. Fees and Funds Payouts

7.1. Account Creation

Creating an Account on the Site is free. Creators can set up and customize their Profiles.

7.2. Payment Processing

Tribl use third-party Payment Service Providers to facilitate Donations and Subscriptions on its Site. Creator’s information may be shared with these processors to complete transactions. Tribl does not store, retain, or process any payment card information.

7.3. Transactions

All transactions made on the Site are conducted directly between Creators and their Fans. Tribl is not involved in the handling or processing of any transactions. All transactions are managed by third-party Payment Service Providers. Fans are encouraged to review the terms of service and privacy policies of these processors before making a Donation or a Subscription.

7.4. Fees

7.4.1. Commission or Platform Fees: Tribl charges the Creator a Platform Fee in the form of 5% on the Total of Donations and Subscriptions.

7.4.2. Fund Release Policy

Funds transferable to Creators on Tribl will be released at the earlier of two events:

  • Upon the Creator’s explicit request for fund release.
  • Automatically 120 days after the funds become available. This policy ensures timely transfer of funds while accommodating for potential situation of Chargebacks.

7.5. Information about other fees from Payment Service Provider(s) and financial institutions.

7.5.1. Processing Fee: Tribl forwards the Transaction fee charged by the Payment Service Provider to the Creator. For example, the Transaction Fee is typically the card Processing Fee charged by the Payment Service Provider and is typically between 1% and 1.5% for transactions with European Economic Area (EEA) Bank Cards and 2.5% to 3.5% for transactions outside the EEA. The processing fee is deducted from the amount that the Fan transfers.

7.5.2. Refund and Chargeback Fees: Tribl will reflect and deduct any refund fees and chargeback fees that may arise by the Payment Service Providers. Refund and Chargeback Fees will be displayed under "Other fees" and charged to the Creator.

7.5.3. When a Fan makes a payment in a currency different from the one linked to their payment method, their financial institution may impose a foreign transaction fee/exchange fee.

7.5.4. When a Fan makes a payment in a country different than the one related to their payment method, and even if payment is made in the same currency as the one associated in their payment method, the relevant financial institution relevant to the payment method used may charge a foreign transaction fee. Tribl does not receive funds from this fee.

7.6. Refunds and Disputes

Tribl retains the authority to issue refunds in the following situations:

  • Fraudulent transactions
  • Unintended duplicate Donations
  • Unintended Subscriptions
  • Refund requests initiated by Creators. Once approved, refunds may take up to 10 business days to be processed. Creators and contributors can request a refund conveniently through Tribl’s customer support chat messaging service or by sending an email to support@tribl.app

8. Terms of use as a Fan

8.1. How Donations and Subscriptions are paid.

The Site allows the Fan to support the Creator(s) of their choice by transferring funds to them via multiple payment method that are supported by the Payment Service Providers. The Fan may opt for a One-off Donation, a Regular Donation, or a Membership Subscription under the conditions defined below:

8.1.1. One-off Donations

One-off Donations may be sent to any Creator, unless the Creator has expressly activated the option on the Site not to receive them. One-off Donations are debited immediately and do not commit the Fan in the long term.

8.1.2. Regular Donations

Regular Donations are a monthly commitment of the Donation amount as chosen by the Fan on the Creator Tribl Page. The amount is debited at payment date and is then debited every 30 days.

8.1.3. Membership

Membership Subscriptions may provide Fans with access to exclusive content, rewards, or privileges as specified by the Creator. The Creator has the option the add the Membership Benefits if they exist while creating the various subscription tiers from the Site.

Membership Subscriptions are billed on a recurring monthly basis and will continue until the Fan cancels the subscription. Membership Subscriptions may be offered for free as well by the Creator.

If a Membership Subscription includes a free trial period, the Subscription fee will be charged for the first time after the specified free trial period ends, unless the Fan cancels the Membership before the free trial period concludes. Upon completion of the free trial, the Fan will transition to an automatically renewing paid subscription.

Fans may cancel their free trial or recurring payments at any time by accessing the Fan payment management portal. Additionally, Fans have the option to upgrade or downgrade their Membership tier of choice.

If a Fan increases their payment during the current billing period, they may receive a credit for any payment already made in that term. For instance, if a Fan upgrades from a monthly Membership to an annual Membership, the amount already paid for that particular month may be credited towards reducing the first year cost of the annual Membership.

If a Fan cancels their Membership or downgrade to the lesser tier, they may lose access to Membership Benefits, including a Creator's exclusive content and other privileges. Additionally, access to offerings and Membership Benefits may be lost if:

  • The Fan’s payment method fails.
  • A Creator blocks the Fan.
  • A Creator ceases to offer content or Memberships on the Tribl’s Site.
  • A Creator deletes their Account.
  • A Creator changes the access rights to an offering or Membership.
  • Tribl removes the Creator from the platform.
  • Tribl changes the access rights to an offering or Membership.

Tribl is not obligated to provide the Fan with access to any specific offering, or enable interactions with any specific Creator.

8.2. Refunds

Tribl’s main policy is not to provide refunds, including whether the Fan loses access to the Membership Benefits. However, Tribl does issue refunds in certain cases as mentioned previously in the Terms under section 7.6.

8.3. Disclosure of Fan information

The Fan acknowledges and agrees that Tribl will provide the Creator they support with the Fan's identity information, including their email address and postal address. This information is shared to enable the Creator to communicate with the Fan via email and to deliver any promised Benefits or rewards, if applicable.

9. Liability Limitation

Tribl, including its directors, employees, affiliates, and agents, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, that result from (i) the use of, or inability to use, Tribl's services; (ii) the actions or content of any third party on the Site; (iii) any content obtained from the Site; and (iv) unauthorized access, use, or alteration of content or transmissions, irrespective of the theory of liability (contract, tort, or otherwise). This limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.

9.1. Service Downtimes and Maintenance

9.1.1. Acknowledgment of Potential Downtimes

The Creator and Fan acknowledges that from time to time, Tribl's Site(s) may be subject to temporary downtimes or be made unavailable due to routine maintenance, technical issues, updates, or other reasons beyond Tribl’s control. While Tribl strives to maintain a high level of service availability and minimize disruptions, Tribl cannot always guarantee uninterrupted access to its services at all times.

9.1.2. Limitation of Liability for Downtimes

No Liability for Losses: Tribl shall not be liable for any loss, damage, inconvenience, or any direct or indirect consequences that may be suffered due to any service downtimes, whether planned or unplanned.

Communication of Planned Downtimes: Whenever possible, Tribl will attempt to provide advance notice of any planned maintenance or updates that may result in service unavailability.

Efforts to Minimize Impact: Tribl commits to taking reasonable steps to ensure that maintenance and technical work are conducted in a manner that minimizes disruption to Tribl’s users and to restore service as quickly as possible.

9.1.3. User Responsibilities During Downtimes

Data Backup: The Creator is responsible for maintaining backups of any content or data that have been uploaded to the Site to prevent potential loss during downtimes.

Staying Informed: It is recommended to check Tribl’s official communication channels for updates regarding service availability, especially during known maintenance periods or service interruptions

By using Tribl’s Site, the Creator agrees to these Terms and acknowledge that Tribl will not be held liable for any interruption, unavailability, or suspension of services.

10. Indemnity Clause

The Creator and the Fan agree to indemnify and hold Tribl, its parents, subsidiaries, affiliates, officers, employees, and agents harmless from any claim, demand, loss, liability, or expense, including reasonable attorneys' fees, arising out of or in connection with: (i) the use of Tribl's services; (ii) a breach or alleged breach of these terms; (iii) the violation of any rights, including intellectual property rights, of a third party; or (iv) the violation of any applicable laws or regulations. This indemnification obligation will survive the termination of the use of Tribl's services and these terms.

11. Dispute Resolution

If a Creator or a Fan encounters any issues or have concerns with the Tribl Site, they are encouraged to first contact Tribl’s customer support for assistance. In the event of a formal complaint, please submit it in writing, detailing the relevant circumstances of the complaint. Should a dispute arise between the Creator or Fan and Tribl that cannot be resolved through customer support, the Creator and/or Fan may have the option to seek alternative dispute resolution with the National Board of Consumer Disputes (Allmänna Reklamationsnämnden, ARN) in Sweden. This service is available free of charge and provides an impartial resolution to consumer disputes. For more information, please visit www.arn.se. Note that complaints to the ARN must be made in writing, and certain limitations regarding time and value may apply. Tribl commits to participating in the ARN’s processing of the dispute. Further information on consumer rights is available at www.konsumenternas.se

11.1. European Union Online Dispute Resolution

Additionally, the Creartors and Fans have the right to use the European Union’s online dispute resolution platform, available at https://ec.europa.eu/consumers/odr/main/?event=main.trader.register. This platform provides an accessible avenue for resolving disputes related to online transactions. More information can be found at www.konsumenteuropa.se

11.2. Jurisdiction

In the event of legal action initiated by Tribl, the courts of Sweden shall have jurisdiction to settle any disputes. However, Tribl reserves the right to bring legal action against the Creator or Fan in a court of another country if the Creator or Fan is a resident or hold assets in that country.

11.3. Governing Law

The Agreement and any related disputes or claims shall be governed by and construed in accordance with Swedish law, without regard to its conflict of law principles.

11.4. Distance Contracts Act

In compliance with the Swedish Distance Contracts Act (Sw. lag 2005:59 om distansavtal och avtal utanför affärslokaler), the Creators and Fans, as consumers, have the right to withdraw from agreements entered into at a distance. However, it is important to note that certain transactions on Tribl, due to their digital nature and immediate fulfillment, may not be subject to the withdrawal right under Chapter 2 §11 Section 11 of the Distance Contract Act.

12. Tribl’s Right to Modify or Discontinue Services

Tribl continuously evolves to improve user experience and adapts to changing needs and technologies. Therefore, Tribl reserves the right to modify, enhance, or discontinue any part of its services or features at any time, without prior notice. This may include adding new functionalities, removing existing features, or adjusting various aspects of the Tribl Site.

13. Changes to Terms Notification of Changes

Tribl reserves the right to modify these Terms at any time to reflect changes in its services, legal obligations, or other necessary considerations.

Tribl holds a dynamic Site, and as such, Tribl may update its services, policies, and these Terms from time to time. Tribl are committed to keeping users informed of any changes that may affect the use of the Site. When Tribl makes significant changes to the Terms, Creators and Fans will be notified either through the email address associated with the Account or payment, through an in-app notification, or by posting a prominent notice on the Site.

14. Review and Acceptance

It is the Creators and Fans responsibility to review any changes or updates to these Terms. This includes changes to policies governing the use of the Site, modifications to the services, and updates reflecting legal or operational developments.

15. Continued Use as Acceptance

The Creator and Fan continued use of the Site after any changes have been made will constitute an acceptance of those changes. If the Creator or Fan does not agree with the updated Terms, they should discontinue their use of Tribl’s services. The continued access to and use of Tribl following the posting of any changes to the Terms constitutes an acceptance of those changes.

16. Effective Date

Changes to the Terms will become effective immediately upon their posting on the Site unless otherwise noted. Tribl encourages both Creators and Fans to periodically review the Terms.
